Public lecture In "Frontline Georgia"

Georgian Institute of Public Affairs (GIPA) with the support of “Promoting Rule of Law in Georgia PROLoG Activity” (PROLoG) is hosting a public lecture at the media club “Frontline Georgia” on October 10 at 19:00 on the following topic:


Disobedience to the police and the human aspiration to freedom

Vakhushti Menabde, a member of the Constitutional Commission, Associate Professor at Ilia State University Law School and the Head of Human Rights Course at the Georgian Institute of Public Affairs will deliver a speech.

Everyone has a natural aspiration to have physical freedom that is not subject to State law enforcement agencies. Such an approach is a personal part of the Constitution and is embedded so deeply in the human mind that it is perceived as an instinctive reaction against the restrictions or the attempt of the restrictions imposed by the State. As a result of this, the State is prohibited to carry out measures against those who do not obey the government’s requirement in order to maintain or retain their own physical liberty. At the same time, it should be taken into account that such disobedience should not endanger the life of another.

We encounter several norms in the Georgian Legislation, the existence of which undermines the above-mentioned vision. They are often used by the State to subdue the civil protests. The speaker will review these norms and the use of these norms in practice, as well as the practice of other countries and the European Court of Human Rights.
